8:58 AM Duke Nukem 3D: 20th Anniversary may be removed from sale by court order |
The Duke Nukem 3D: 20th Anniversary Edition World Tour is a remake of the 1996 Duke Nukem 3D released on the Xbox One, PS4, and PC in 2016. The remake features a soundtrack of 16 songs from the original game, composer Bobby Prince. Prince claims that he had a license agreement with the original developer of Duke Nukem 3D, however, Gearbox, when purchasing the rights to the Duke Nukem franchise in 2010, did not acquire the right to music from him.
A document submitted to the U.S. District Court said that Randy Pitchford, the CEO of Gearbox, admitted that Gearbox did not have a license, but refused to remove the original music from the game without paying Prince's fee. In addition, Prince also sent a request to Valve to remove the game from Steam due to a violation of copyright law.
Gearbox and Valve have 21 days to defend their position in court. There is no final decision yet, but it is known that many games were withdrawn from sale due to litigation or expired licenses.
